Contact Information
If you contact us via the form on the website or by email, we will store the data you provide for six months for the purpose of processing your enquiry and follow-up questions. We will not pass such data on without your consent.
Your Rights
You have rights to access, rectification, erasure, restriction, data portability, withdrawal of consent and objection regarding your data as we stored them. If you believe that the processing of your data infringes data protection law or that your rights to data protection have been breached in any other way, you can send a complaint to us or the Data Protection Authority (Datenschutzbehörde/DSB).

Web analytics with Google Analytics
If you have given your consent, our website will use functions of the Google Analytics web analysis service. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Cookies are being used for this purpose; these enable an analysis of website use by visitors. The information thus generated is transferred to the provider's server and stored there. You can prevent this by adjusting your cookies consent accordingly.
A contract for data processing has been concluded with the provider. As the privacy of users is important to us, user data is pseudonymised (e.g., by deleting the last 8 bits). This means that only rough localization is possible. The relationship with the web analytics provider is based on contractual data processing. Data are erased regularly (currently every 26 months).
Data processing is carried out on the basis of Section 96 (3) of the Austrian Telecommunications Act (Telekommunikationsgesetz/TKG) and Art. 6 (1) lit. a (consent) and/or f (legitimate interest) of the GDPR. The purpose within the meaning of the GDPR (legitimate interest) is to improve the offer and the website.
Google reCaptcha
Our website uses the reCaptcha service from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, as a protection from spam and abusive interactions via email. When you use our contact form, reCaptcha will automatically be activated and user data such as your IP address, browser data, operating system, and possibly other data will be collected by Google in order to distinguish real users from bots. If you do not want this to happen, please use your own email programme to send us a message and do not go through the form. The legal basis here are Section 96 (3) TKG and Art. 6 (1) lit. f of the GDPR. Our legitimate interest is the security of our users and the prevention of unsolicited emails. General Privacy Policy
1. Protection of Personal Data
We, civil-law notaries Dr. Alexander Michalek and Robert Aschinger, 1080 Vienna, Josefstädter Strasse 34, will process your personal data exclusively based on your consent or for the purpose of fulfilling the mandate or order you have given us for the purposes agreed upon with you, or on a different legal basis (within the meaning of the GDPR). We will only collect personal data which are required for the performance and management of our notarial tasks and services or which you have voluntarily provided to us. As regards the transactions referred to in Section 36a (1) of the Notarial Code (Notariatsordnung/NO), e.g., real-estate transactions, corporate law transactions and the like, we are subject to special legal obligations under the NO when processing personal data so as to prevent money laundering and terrorist financing (in particular, reference is made to Section 36a-36f NO here). The processing of personal data on the basis of the NO for the prevention of money laundering and terrorist financing is to be considered a matter of public interest under the GDPR.
2. Your Right to Access and Erasure (Rights of Data Subjects)
You have the right to access regarding your stored personal data, their origin and recipients, and the purpose of data processing, as well as the right to rectification, objection, data portability, restriction of processing, and blocking or erasure of incorrect/unlawfully processed data. There may be restrictions arising from a notary's duty of confidentiality pursuant to Section 37 NO.
You also have the right to withdraw any consent you may have given to the use of your personal data at any time. To assert your rights as a data subject (access, erasure, rectification, objection, and/or data portability, provided that data transfer does not involve disproportionate effort), please contact our firm (Civil-law notaries Dr. Alexander Michalek or Mag. If you believe that the way in which we process your personal data infringes applicable data protection law or that your data protection rights have been breached in any other way, you have the option of lodging a complaint with the competent supervisory authority. In Austria, this is the Data Protection Authority (Datenschutzbehörde/DSB).
3. Use of Data – Security
The data provided to us will not be processed for purposes other than those specified by the mandate you have given us or by your consent, or otherwise by a provision under the GDPR. This does not include data use for statistical purposes, provided that the data provided have been anonymised.
We have taken state-of-the-art organisational and technical precautions to ensure the protection of your personal data (protection against misuse both internally and externally, e.g., through firewalls, encryption, access authorisations, etc.).
However, it cannot be ruled out that information may be viewed or used by other persons due to errors in data transmission which we did not cause or due to unauthorized access by third parties (hackers, etc.). We assume no liability in this respect unless we were culpably at fault for such misuse.
4. Disclosure of Data to Third Parties (Transfer)
As a matter of principle, we do not make your personal data available to others. However, it may be necessary to pass your data on to third parties in order to fulfil your mandate or for reasons prescribed by law. Such third parties may include courts, authorities, legal representatives, or other third parties involved (including data processors working for us under a contract). In this case, your data will only be disclosed in keeping with the GDPR (based on your consent, for the fulfilment of a contract or a legal obligation, etc.).
In our capacity as civil-law notaries and within the scope of our notarial activities, we will regularly obtain information about you from third parties.
We would also like to point out that we may transfer your personal data to recipients (see above) outside your country. However, we will only transfer your personal data on the basis of the GDPR (which requires an adequate level of data protection or the implementation of measures to ensure that all recipients have an adequate level of data protection).
5. Storage/Erasure of Data
We do not store your personal data for longer than is necessary for the purposes for which they are being processed. Data will also be stored for evidentiary purposes, taking into account the periods under the statute of limitation, or for as long as it is possible to assert a claim against us as a contractor (liability).
